WHAT IF THE VICTIM IS DECEASED?
It is reasonable that reparation should benefit those whom the person concerned would have wished. Since it is not easy to determine that intention, one may start from the presumption that the aggrieved person would have wanted to leave the compensation to their heirs, although it could also be that they would have preferred to give all or part of it to an organisation or cause, for example to fight against the abuse of which they were a victim. Such assessments fall, in each case, to any party responsible for the harm who wishes to repair it voluntarily, or to any judge who establishes it as mandatory.
Thus, for example, the harm we have caused to the tens of thousands of non-human farm and fish farm animals we have consumed throughout our lives can be redressed by fighting against the victimization of these animals. This would probably have been the victims’ will.
LET’S REPAIR THE DAMAGE!: Also the damage caused to non-human animals
AND WHEN SOCIETY IS THE VICTIM?
When harm is caused to society as a whole, it is also appropriate to make amends. For example, in cases of theft, physical assault, or rape, it is equitable to pay police and judicial costs, as well as to compensate the community for the reduced quality of life that insecurity entails.
AND WHAT IF THE VICTIMIZERS ARE MINORS, PETS, OR THE STATE?
Parents are responsible for assuming liability for damages caused by their minor children, and pet owners for damages caused by their pets. No one is obligated to be a parent, but all who choose this option must take responsibility for the possible consequences.
It is also just that politicians and public officials repair the damages (including moral damages) they cause to specific citizens or to society as a whole in cases of malfeasance, corruption, embezzlement, convictions without sufficient evidence, or wasteful spending due to selfish interests. If they cause harm acting in good faith, it is fair for the State to compensate, but when this is not the case, taxpayers should not bear that compensation; rather, the abuser should, from their own pocket and, if necessary, with work hours.
It is also just that the State pays the citizen who wins lawsuits the legal costs incurred by them, as well as the moral damages caused by the former.
To live in a just society, it is necessary to avoid unredressed impunity, which is the perfect breeding ground for abuses to perpetuate. In fact, criminology experts affirm that the best way to maintain law and order in a society is to strive to be as just as possible.
But, unfortunately, all of the above is an ideal of justice that does not correspond to reality, at least in many countries.
If you want to make it a reality and achieve a more just world, I encourage you to:
