CORPORAL PUNISHMENTS
The Quran prescribes certain corporal punishments, such as crucifixion, amputation, stoning, or flogging, which are contrary to international human rights standards, specifically under the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
Crucifixion and Amputation
Quran 5:33:
“The recompense of those who wage war against Allah and His Messenger and strive to spread corruption in the land is that they should be killed or crucified or that their hands and feet should be cut off on opposite sides or that they should be exiled from the land. This is a disgrace for them in this world, and in the Hereafter, they will have a tremendous punishment.”
Quran 5:38
“As for the thief, male or female, cut off their hands as a recompense for what they have committed, a deterrent punishment from Allah.”
For this reason, these barbarities continue to be applied in countries like Saudi Arabia and Nigeria.
Rajm (Stoning)
Quran 7:84:
And We rained down upon them a shower of stones. So observe how was the end of the criminals.
Something similar is stated in Quran 11:82, Quran 26:173 and Quran 27:58
There are many Hadith (biographies containing the sayings and deeds of Muhammad, which constitute the second pillar of traditional Islam after the Quran) that state that this prophet ordered certain people to be stoned to death. Among these, we highlight Sahih Bukhari 8:82:803.
Narrated Ash-Sha’bi: from ‘Ali when the latter stoned a lady to death on a Friday. ‘Ali said: “I have stoned her according to the tradition of Allah’s Apostle.”
This is why stoning continues to take place in countries like Sudan and Afghanistan.
Flogging
Qur’an 24:2:
“The fornicatress and the fornicator, flog each of them with a hundred stripes.”
That is why this type of punishment is inflicted in countries such as Brunei, Iran, Libya, Maldives, Malaysia, Yemen, Qatar, Indonesia, etc.
TORTURE
Quran 4:56:
“Indeed, those who disbelieve in Our verses, We will burn them in a Fire. Every time their skins are roasted through, We will replace them with other skins so they may taste the punishment. Indeed, Allah is Exalted in Might and Wise.”
Quran 22:19-22:
“For those who disbelieve, garments of fire will be cut out for them; boiling water will be poured over their heads, melting that which is in their bellies and their skins. And for them are maces of iron. Every time they want to emerge from it due to anguish, they will be returned to it, and it will be said, ‘Taste the punishment of the burning fire.'”
These verses can be interpreted as punishment in the afterlife, but in the Hadith, it is clearly prescribed for the earthly world:
Ibn Ishaq, “Sirat Rasul Allah” (The Life of Muhammad), p. 515:
“When Khaibar was conquered, Kinanah ibn al-Rabi was brought before the Prophet, who questioned him about the whereabouts of the Banu Nadir’s treasure. Kinanah denied knowing where it was. Then, a Jew came to the Prophet and said that he had seen Kinanah lurking near a certain place. So the Prophet said to Kinanah: “Do you know that if we find the treasure in that place, I will kill you?” Kinanah said yes. Then, the Prophet ordered the place to be excavated, and the treasure was found. Then the Prophet ordered Kinanah to be tortured to reveal the whereabouts of other hidden goods. Kinanah was tortured with fire and then was beheaded by Muhammad ibn Maslamah.”
Ibn Ishaq, “Sirat Rasul Allah” (The Life of Muhammad), p. 664:
“The Prophet sent him again with a force to attack Banu Fazara. He captured Umm Qirfa, who was a highly respected old woman among her people. They tied each of her legs to a different camel and made them run in opposite directions, thus brutally dismembering her.”
Sahih Bukhari, Volume 4, Book 52, Hadith 261:
“The Prophet sent (some men) in their pursuit and they were captured and brought, and he cut off their hands and feet and gouged out their eyes, and then left them in the Harra (a rocky place in Medina) until they died.”
Therefore, it is not surprising that torture continues to be applied in countries such as Turkey, Syria, Egypt, Saudi Arabia, Yemen, Iran, etc.
SLAVERY
Muslim countries have been heavily involved in slavery from their inception until the 20th century. This changed because the European colonial empires that dominated most Islamic lands prohibited slavery.
Although legally prohibited in all states worldwide, it still exists in some, such as Mauritania, South Sudan, Yemen, Nigeria, Bangladesh, and Afghanistan. The religious basis for this institution in these places is as follows.
Quran 4:3:
“If you fear that you will not be just with the orphans, then marry those women who please you: two, three, or four. But if you fear that you will not be equitable, then only one, or those your right hands possess (slave-women).”
Quran 4:25:
“And whoever among you cannot afford to marry free, believing women, let him marry from among your believing slave-women.”
Quran 70:29-30:
“And those who guard their chastity, except with their wives or those their right hands possess (slave-women), for indeed, they are not to be blamed.”
Quran 24:32:
“Marry the unmarried among you and the righteous among your male and female slaves.”
To be fair, it should be noted that Muhammad was more benevolent in his treatment than the standards of the time, even advising the liberation of slaves.
The Hadith not only support slavery but even recount that Muhammad owned slaves, such as Sahih Bukhari 4:52:256, Sahih Bukhari 5:59:512, or Sahih Muslim 8:3327.
CONFINING A WOMAN IN HER HOME TO DIE OF HUNGER AND THIRST
Qur’an 4:15:
“And those of your women who commit immorality, call four witnesses from among you against them; and if they testify, confine them to houses until death takes them or Allah ordains for them another way.”
